Vaccines: The legal risks of a third dose

The European Commission warns of the legal consequences of the third dose of vaccine since the European Medicines Agency (EMA) has not yet validated the principle of this vaccine booster.

The European Commission has just thrown a spanner in the works regarding the injection of a third dose of vaccine decided by eight European countries, including France.
In a statement published by Reuters, the European executive warns “EU member countries [that] could expose themselves to increased legal risks, as the administration of a booster has not yet been recommended by the European Medicines Agency (EMA).”

Not enough data

Indeed, the Commission recalls, “the EMEA has repeatedly indicated that it does not have sufficient data to be able to decide on the possible need for a booster vaccination against COVID-19.” It adds, “Booster doses are not currently included in the marketing authorizations for Covid-19 vaccines and have not yet been scientifically evaluated by the EMEA due to insufficient data.”
In other words, the Commission warns of possible deleterious side effects of the vaccination that could be attributed to these boosters and, therefore, engage the responsibility of each of the States concerned. As a result, the laboratories supplying these vaccines would be totally exempt from prosecution and compensation claims.
In France, the French National Authority for Health (HAS) issued its recommendations on August 24, 2021 and validated the principle of a third vaccine dose for people over 65 years of age and those suffering from comorbidities. The campaign will start in September.

Legal and health risks

The legal risks faced by states that advocate the third dose of vaccine are a consequence of the health risks that these boosters pose to patients. The World Health Organization (WHO) has advised against booster campaigns several times.
In France, it is the National Office for Compensation of Medical Accidents (ONIAM) that deals with possible compensation for damages caused by drugs.
